Since he was taken to the hospital on time after the event, he suffered no permanent damage and will be able to leave soon. He even tries to prove that Michael is envious of him because his mother was giving him more time instead of spending time with her own family.
Rusty also intentionally goes a little overboard with his accusations towards Michael to get his father all riled up. Everything goes as planned when Carolyn’s husband gets aggressive in court and attempts to attack him. Following these events, Guardia fears the trial may not be going in the direction they expected.

When he goes to his bedroom, he finds a window open, suggesting that someone was in his house moments before he came in. When he looks at a table in his room,he finds a fireplace poker with a message saying, “Go F**k Yourself!“Given how the fireplace poker was believed to be the murder weapon, it seems like Carolyn’s real killer might have left it there.
The murder weapon was not previously found at the crime scene and could have been a crucial piece of evidence in the case. However, with the weapon now in Molto’s home, there isn’t much the prosecution can do to present it as evidence in court. This also raises the possibility that Molto had hired someone to commit the murder, and the murderer is now turning against him inPresumed Innocent.
